  1. What this Privacy Policy covers

This website, located at https://www.fillr.com (the “Site”), is operated by Pop Tech Pty Ltd (ABN 82 164 555 748 / ACN 164 555 748) d/b/a Fillr (“Fillr,” “we” or “us”), part of the Rakuten Group, which includes the affiliates and subsidiaries of our parent company, Rakuten Group, Inc., based in Tokyo, Japan. Fillr provides certain web and mobile form-filling technology and services (together, “Fillr Products”) which integrate into the mobile or desktop web browser applications of our business clients (“Clients”).

This Privacy Policy applies to Site visitors only and explains how Fillr collects, processes, uses, and discloses personal data we may collect about you when you access or use this Site or otherwise communicate with us. We only process personal data from Fillr Products on behalf of our Clients, and their privacy policies apply to such personal data.

When you interact or communicate with us via this Site or otherwise, we may collect the following types of information about you:

  • Identifiers, such as your name, email address and any other personally identifiable information you may choose to provide to us in the course of corresponding with us; and
  • Commercial informationsuch as the types of services you consider or express interest in.  

We do not collect, use, or disclose any personal data that is defined as “sensitive” personal information under the California Consumer Privacy Act of 2018 as thereafter amended (“CCPA”) or other U.S. state privacy laws or any “special categories” of data under GDPR.

To provide our Site and services - We use personal data we collect about you to provide you our Site and a method for you to request that we contact you or provide you a quote for services.

To communicate with you and provide you customer service - We use your contact information like email address to communicate with you in order to respond appropriately to your enquiries, complaints, or requests for information about our services communicated to us through our Site or otherwise. 

To comply with legal obligations - We may use your information as necessary to comply with obligations we have under applicable laws to compile, maintain, and file required records or reports, to cooperate with regulators or law enforcement agencies as to official investigations or respond to legal processes. 

To exercise or protect our rights - We may use your information to exercise or protect our legal rights, such as prosecuting or defending against intellectual property (copyright, trademark, patent, trade secret, counterfeiting) actions, fraud claims, or violations of our or third parties’ rights.    

To protect you, others, and our business - We may use collected information to limit spam, malware, and other malicious online activities and security risks, and to improve and enforce our Site security measures, or otherwise as necessary to protect the safety, security, and legal rights of persons and/or Fillr or to enforce our agreements or policies.

In the European Economic Area, including the European Union, we must have a valid purpose, known as the “legal basis,” to process your personal data.  We process your personal data for the purposes described above, under the following legal bases:

Legitimate interests - To meet our legitimate interests as a business, for example for business lead generation and to understand and analyze demand for our business services.  When we process personal data to meet our legitimate interests, we put in place robust safeguards to ensure that your privacy is protected and to ensure that our legitimate interests do not override your fundamental rights and freedoms.  You may object to our use of your personal data for the above purposes.

We may disclose your personal data for business purposes, as follows:

To Our affiliates and subsidiaries - We may disclose information that we collect about you with our affiliates and subsidiaries or other Rakuten-related entities in order redirect or resolve inquiries from you regarding services that they provide.

To vendors - We may disclose your personal data as necessary to service providers and other third parties that perform services for us, for a business purpose, including business operations-related services such as IT services.  To the extent we do so, we agree to contractual terms requiring them to protect your personal data in accordance with this Privacy Policy and applicable privacy laws.

To comply with law - We may disclose information about you in response to an official request for information, if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet law enforcement requirements.

To protect Fillr or others - We may disclose your information if we believe your actions are inconsistent with our user agreements or policies, if we believe you have violated the law, or to protect the rights, property, and safety of Fillr or others.

In connection with a business transaction - We may disclose your information in confidence in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company. In such an event, we will take commercially reasonable steps to require the acquiring company to continue to honor this privacy policy with regard to any collected personal data.  

With Your consent or at Your direction - We may disclose your personal data when directed or authorized by you in order to provide you with a service you have requested.

In addition to the above listed disclosures regarding personal data, we may also disclose aggregated or de-identified information that cannot reasonably be used by recipients to identify you.

You have certain rights regarding your personal data based on applicable local laws, which may include the following rights:

To access your personal data/data portability – You have the right to request that we send you a copy of your personal data in our possession, in a readily usable and portable format. 

For California residents, in addition to the specific pieces of your personal information, you also have the right to request that we provide you:

  • The categories of personal information we have collected about you;
  • The categories of sources from which we collected your personal information; and
  • The categories of service providers and third parties to whom we disclosed your personal information and the purposes for such disclosures.

Fillr does not “sell”, “share”, or process personal information for “targeted advertising” as those terms are defined in the CCPA and other U.S. state privacy laws.

To correct the information we hold about you – You have the right to request that we correct any personal data you believe is inaccurate or complete any information you believe is incomplete.

To erase or delete your personal data – You have the right to request that we erase or delete your personal data under certain conditions or subject to certain legal exceptions. 

To restrict our processing of your personal data – You have the right to request that we restrict our processing of your personal data, under certain circumstances.

To object to our processing of your personal data – You have the right to object to our processing of your personal data, under certain circumstances. 

To lodge a Complaint with your local data protection authority.

To appeal our decision regarding your privacy rights request, depending on your state of residence. You may submit an appeal request by contacting us as set forth below. We will respond according to the law applicable in your location.

To not be retaliated against for exercising privacy rights - We will not retaliate or discriminate against you for exercising any of your privacy rights by denying you goods or services, charging you different prices or rates for goods or services, including through granting others or denying you discounts or other benefits or imposing penalties, providing you a different level or quality of goods or services, or suggesting that you may receive a different price or rate for goods or services or a different level or quality of goods or services if you exercise your rights to access or delete your personal information.

To exercise your privacy rights, please send a written request addressed to the Privacy Officer, Pop Tech Pty Limited, by mail at Level 8, 11 Spring Street, Sydney NSW 2000 AUSTRALIA or by sending an email to fillr-privacy@mail.rakuten.com.

Please note that requests must be verifiable, and that in order for us to verify your identity, we will need to match certain information you provide in your request with data that we maintain and have determined to be reliable for the purposes of identity verification. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.  If we are unable to verify your identity with reasonable certainty, we may deny your request as permitted by law.  If your request is to know or access specific pieces of personal information, you will be required to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request.  You may not make a request to know or access your information under the CCPA more than twice within a 12-month period. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information.  We may require any agent making a request on your behalf to provide written permission from you to submit a request on your behalf and to verify their identity and authorization to do business in California, as applicable, or demonstrate that he or she has power of attorney in connection with your request to know, access or delete.

California law permits residents of California to request certain details about how their information is shared with third parties for their direct marketing purposes.  We do not share your information with third parties for their direct marketing purposes.

  1. Do Not Track and Global Privacy Control disclosure

Fillr does not currently take actions to respond to Do Not Track signals or honor Global Privacy Control as an opt-out signal, because we do not undertake any activities requiring these mechanisms. 

  1. Notice regarding the information of minors

This Site and our services are intended for adults, and we do not knowingly collect or sell personal information of minors under the legal age of consent without affirmative authorization or without verifiable, opt-in consent from a parent for those consumers under age 13.

  1.         Processing and transfers of personal data outside EEA

If you are accessing this Site from outside the United States, please be aware that you may be sending information (including personal data) to our servers located the United States or other countries outside of the EEA, which countries may have data protection laws that are less restrictive than those in your country of residence, or we may need to transfer your personal data outside of the country of origin for the purposes of storage or processing. If we transfer your personal data to third party processors outside of the EEA, we take legally required steps to ensure that appropriate safeguards, such as agreement to Standard Contractual Clauses are in place to protect your personal data.

We may retain information about you for as long as it is necessary to fulfill the purposes described Section 3. Some of your information may be retained in our systems even after you request your information to be deleted, only as necessary in order to comply with our obligations under applicable law, resolve disputes, enforce our legal rights, and to undertake any investigations necessitated by the foregoing.

We have implemented technical and organizational measures to provide a level of security appropriate to the risk to the personal data that we process. These measures are aimed at preserving the ongoing integrity and protecting the confidentiality of users’ personal data. We evaluate these measures on a regular basis to confirm that they continue to maintain and apply an appropriate level of security.

We may change this Privacy Policy from time to time.  If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, we may provide you with additional notice (such as adding a statement to our website homepage).  Changes are effective upon such notice. We encourage you to review the Privacy Policy whenever you access the Site or otherwise interact with us to stay informed about our information practices and the choices available to you.
